By accessing or using opuestoaqua.com, placing an order, submitting a custom design request, or otherwise engaging with ·opuesto·aqua’s products or services, you agree to be bound by these Terms of Service (“Terms”).
If you do not agree with any part of these Terms, you must not use this website or place any order. These Terms apply to all visitors, customers, and team purchasers.
·opuesto·aqua is a sub-line of the ·opuesto· brand, specializing in high-performance custom swimwear and aquatic teamwear for competitive swimmers, water polo athletes, triathletes, and open-water sport participants.
·opuesto· was founded on the principle of being the opposite of conventional — eccentric, authentic, and surrealist by design. Our garments are manufactured using high-quality, performance-grade fabrics including moisture-wicking, UV-protective, antimicrobial, and quick-dry materials.
·opuesto·aqua offers two categories of products: Teamwear and Swimwear. Many products are made-to-order with custom design options. The following terms apply specifically to custom orders.

Many ·opuesto·aqua products are fully customizable — including team colors, logo placement, and pattern design. Custom orders are subject to the following conditions:
No Minimums: ·opuesto·aqua accepts custom team orders of any size — from a single athlete to a full squad. Pricing may scale with volume; contact us for team quotes at orders@opuestoaqua.com.
·opuesto·aqua offers a wide size range across all product categories. Customers are responsible for selecting the correct size at the time of order. Size charts are provided on each product page and should be consulted before purchase.

Because many of our garments are made-to-order and custom-produced, ·opuesto·aqua cannot accept returns or exchanges based on incorrect size selection by the customer. We strongly encourage customers to:
·opuesto·aqua performance fabrics (polyester-spandex and recycled polyester blends) are designed to provide a close, athletic fit. Competition swimwear should be fitted snugly; teamwear styles vary between fitted and relaxed silhouettes — refer to individual product descriptions.
All prices are listed in USD (United States Dollars) unless otherwise stated. Prices are subject to change without notice. The price applicable to your order is the price displayed at the time of checkout confirmation.
For custom team orders exceeding a value determined by ·opuesto·aqua, a 50% deposit may be required before production begins. The remaining balance is due prior to shipment. Failure to complete payment will result in the order being held until full payment is received.
·opuesto·aqua ships internationally from Colombia. Prices shown on the website may not include import duties, customs taxes, or local VAT applicable in your country. The customer is solely responsible for any additional charges imposed by their country’s customs authority upon delivery.
Fraud Prevention: ·opuesto·aqua reserves the right to cancel any order that shows signs of fraud or unauthorized payment. In such cases, customers will be notified and any valid payment refunded.
All orders are reviewed and confirmed within 1–3 business days of receipt. Custom orders require design approval before production. Standard in-stock items are processed within 3–5 business days.
For all custom orders, ·opuesto·aqua will provide a digital design proof before production begins. The customer must approve the design in writing. Production will not start until written approval is received. By approving the proof, the customer confirms:
·opuesto·aqua is not responsible for errors approved by the customer in the design proof.
Orders for custom or made-to-order items may not be cancelled once production has begun. Cancellation requests for orders not yet in production must be submitted within 24 hours of order confirmation and are subject to a processing fee. In-stock, non-customized items may be cancelled before shipment without penalty.
·opuesto·aqua ships nationally within Colombia and internationally to select countries. Shipping costs and estimated delivery times are calculated at checkout based on destination and order weight.
For international orders, estimated delivery is 10–25 business days after dispatch, depending on destination. Customs clearance may add additional time. The customer is responsible for all import duties and customs fees (see Section 5.3).
Shipping issues: If your order arrives damaged or does not arrive within the estimated window, contact orders@opuestoaqua.com within 10 days of the estimated delivery date with your order number and photos of any damage.
·opuesto·aqua takes pride in the quality of every garment. Our return policy is designed to be fair while reflecting the nature of our custom-made products.

Returns are accepted for non-custom, in-stock items that are:
Approved returns will receive a store credit or exchange. Cash refunds are issued only in cases of manufacturing defect or incorrect item shipped.
If you receive an item with a manufacturing defect or an item that does not match your order, contact orders@opuestoaqua.com within 7 days of delivery with your order number and clear photographs of the issue. We will assess and provide a replacement or full refund at our discretion.
Return shipping costs are the responsibility of the customer unless the return is due to a manufacturing defect or error on our part. We recommend using a trackable shipping service — ·opuesto·aqua is not responsible for returned items lost in transit.
All content on opuestoaqua.com — including the ·opuesto·aqua logo, brand name, the distinctive mirrored/inverted logotype, wave graphic elements, skeleton fish illustration, octopus illustration, and all associated brand imagery — is the exclusive intellectual property of ·opuesto·.
When you submit artwork, logos, or design files for custom order production, you confirm that:
Users of opuestoaqua.com agree to use the website only for lawful purposes and in a manner consistent with these Terms. You agree not to:
·opuesto·aqua reserves the right to refuse service, cancel orders, or block access to any user who violates these standards.
To the fullest extent permitted by applicable law, ·opuesto·aqua, its founders, employees, partners, and suppliers shall not be liable for any indirect, incidental, consequential, or punitive damages arising from:
·opuesto·aqua products are designed for athletic and recreational aquatic use. While our garments are tested for performance and durability, we do not guarantee specific athletic outcomes. UV protection ratings (UPF) are based on fabric testing and may vary with wear and washing over time. Always follow care instructions provided with each garment.
Our total liability to any customer, in any case, shall not exceed the total amount paid for the specific order giving rise to the claim.
·opuesto·aqua collects personal data (name, email, shipping address, phone number) solely for the purpose of processing and fulfilling orders, communicating about your purchase, and improving our service.
Data Security: Payment information is processed through secured, PCI-compliant payment gateways. ·opuesto·aqua does not store full credit card numbers on its servers.
These Terms of Service are governed by and construed in accordance with the laws of the Republic of Colombia, including consumer protection regulations under Law 1480 of 2011 (Estatuto del Consumidor) and applicable e-commerce regulations.
For customers located in other countries, your local consumer protection laws may grant you additional rights that these Terms do not override. Nothing in these Terms limits rights you have under applicable mandatory consumer protection law in your country.
Customers in Colombia have rights under Law 1480/2011, including the right to receive accurate product information, the right to a functioning product, and the right to submit complaints to the Superintendencia de Industria y Comercio (SIC). For consumer complaints: www.sic.gov.co.
